This End User Licence Agreement (EULA) governs your access to and use of Cosma, including the Cosma website, web app, software, features, content, designs, tools and related services.
By accessing, creating an account for, or using Cosma, you agree to be bound by this EULA. If you do not agree to this EULA, you must not access or use Cosma.

the person who accesses or uses Cosma, including any parent, guardian or authorised user (you, your, User).
Where you allow a child to use Cosma, you are responsible for that child’s use of Cosma and for ensuring their use complies with this EULA.
Cosma is a pocket money tracking and educational tool designed to help parents and guardians teach children money habits and life skills.
Cosma may include features such as digital buckets, pocket money tracking, savings goals, spending records, investing concepts, parent approvals, waiting periods, limits, prompts and educational content.
Cosma is not a bank, debit card, credit card, Visa card, payment provider, financial product, investment platform, stored value facility or financial service.
Cosma does not hold, transfer, spend, receive, invest or manage real money on behalf of Users.
Any balances, buckets, goals, transactions or amounts displayed in Cosma are for tracking, learning and educational purposes only.
Subject to your compliance with this EULA, Cosma grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use Cosma for personal, domestic and family educational purposes.
This licence does not transfer ownership of Cosma, or any intellectual property rights in Cosma, to you.
You may only use Cosma in accordance with this EULA, our Terms and Conditions, our Privacy Policy and any reasonable instructions or guidance we provide.
Cosma is intended to be used by children only under the supervision of a parent or guardian.
You must be at least 18 years old to create a parent or guardian account.
If you create an account for a child or allow a child to use Cosma, you confirm that:
Cosma is provided as an educational and organisational tool only.
Any content, examples, prompts, illustrations or explanations provided in Cosma are general in nature and do not take into account your personal circumstances, objectives, financial situation or needs.
Cosma does not provide financial advice, legal advice, tax advice, investment advice, credit advice or professional advice.
You should seek appropriate professional advice before making financial, legal, tax, investment or credit decisions.
You acknowledge and agree that:
When a child wants to spend money recorded in Cosma, the parent or guardian remains responsible for deciding whether to approve the purchase, covering the purchase and updating the record in Cosma if appropriate.
You are responsible for keeping your account login details secure.
You must not share your parent or guardian login details with any unauthorised person.
You must notify us promptly if you suspect unauthorised access to your account.
You are responsible for all activity that occurs under your account, except to the extent caused by our negligence, wilful misconduct or breach of law.
You must not, and must not attempt to:
All rights, title and interest in Cosma are owned by or licensed to us.
This includes all intellectual property rights in the Cosma name, trade marks, logos, branding, product concepts, app flows, bucket system implementation, illustrations, visual designs, user interface, user experience, text, copy, educational content, graphics, icons, software, source code, object code, databases, documentation, website content and related materials.
You must not use our intellectual property without our prior written permission, except as expressly permitted under this EULA.
Nothing in this EULA assigns or transfers any intellectual property rights to you.
You may enter information into Cosma, including names, nicknames, ages, pocket money amounts, bucket balances, savings goals, transaction descriptions, notes, preferences and other family money information (User Content).
You retain ownership of your User Content.
You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, process, reproduce, display, back up and use your User Content for the purposes of:
You are responsible for ensuring your User Content is accurate, lawful and appropriate.
You must not enter sensitive, harmful, offensive or unnecessary personal information about a child into Cosma.
You may provide feedback, ideas, suggestions, requests or recommendations about Cosma.
If you do, you agree that we may use, develop, adapt, modify, publish, commercialise or incorporate that feedback without restriction, payment or obligation to you.
You acknowledge that we may already be developing similar features, ideas or improvements.
Cosma is a growing product and may change over time.
We may update, modify, suspend, remove or discontinue features, functionality, designs, content or access to Cosma from time to time.
We may provide updates automatically or require you to refresh, update or use a supported browser or device.
We do not guarantee that any particular feature will remain available.
If you access Cosma during a beta, pilot, trial or early access release, you acknowledge that Cosma may be incomplete, experimental or subject to errors.
Beta or early access features may be changed, limited, suspended or removed.
You should not rely on beta or early access functionality as final or permanent functionality.
Your use of Cosma is also governed by our Privacy Policy.
Because Cosma may involve information about children, you must ensure that you only provide information you are authorised to provide.
You must supervise any child’s use of Cosma and ensure that personal information entered into Cosma is appropriate and limited to what is reasonably necessary.
You may request access, correction or deletion of personal information in accordance with our Privacy Policy.
The Privacy Act protects personal information regardless of age, and a child’s ability to consent depends on capacity rather than a fixed age.
Cosma may rely on, integrate with or link to third-party services, including hosting providers, analytics tools, email platforms, payment processors, authentication providers or external websites.
We are not responsible for third-party services and do not control their terms, security, availability, content or privacy practices.
Your use of third-party services may be subject to separate terms and policies.
We will use reasonable efforts to make Cosma available, but we do not guarantee that Cosma will be uninterrupted, secure, error-free or available at all times.
Cosma may be unavailable due to maintenance, updates, outages, technical issues, security incidents or events beyond our reasonable control.
Nothing in this EULA excludes, restricts or modifies any rights, remedies, guarantees or protections that cannot be excluded under the Australian Consumer Law or other applicable laws.
Where we are permitted to limit liability for a breach of a consumer guarantee, our liability is limited, at our option, to resupplying the services or paying the cost of having the services supplied again.
To the maximum extent permitted by law, and subject to any non-excludable consumer guarantees:
To the maximum extent permitted by law, and subject to any non-excludable rights, we are not liable for any indirect, consequential, special, incidental or punitive loss or damage, including loss of profit, loss of revenue, loss of data, loss of goodwill, loss of opportunity, business interruption or reputational damage.
To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with this EULA or Cosma is limited to the amount you paid to use Cosma in the 12 months before the claim arose, or AUD $100 if you have not paid us any amount.
This limitation does not apply to liability that cannot lawfully be limited.

We may suspend or terminate your access to Cosma if we reasonably believe that:
You may stop using Cosma at any time.
On termination, your licence to use Cosma ends immediately.
Sections dealing with intellectual property, restrictions, disclaimers, limitation of liability, indemnity, privacy, governing law and any provisions that by their nature should survive termination will continue to apply.
You may request deletion of your account or personal information in accordance with our Privacy Policy.
We may retain information where required or permitted by law, including for security, legal, tax, accounting, dispute resolution, backup or legitimate business purposes.
You must not assign, transfer or novate your rights or obligations under this EULA without our prior written consent.
We may assign, transfer or novate our rights or obligations under this EULA as part of a business sale, restructure, merger, acquisition or transfer of Cosma, provided this does not materially reduce your rights under this EULA.
We may update this EULA from time to time.
If we make material changes, we will take reasonable steps to notify you, such as by email, in-app notice or website notice.
Your continued use of Cosma after the updated EULA takes effect means you accept the updated EULA.
If you do not agree to the updated EULA, you must stop using Cosma.
If any part of this EULA is invalid, unlawful or unenforceable, that part will be read down to the extent necessary or severed, and the remaining provisions will continue in full force.
This EULA, together with our Terms and Conditions and Privacy Policy, forms the agreement between you and us regarding your licence to access and use Cosma.
To the extent of any inconsistency between this EULA and the Terms and Conditions, the Terms and Conditions prevail unless stated otherwise.
This EULA is governed by the laws of New South Wales, Australia.
The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts entitled to hear appeals from those courts.
